Terms of Service

Rental Requirements

To rent a vehicle from VCARZ, you must meet the following requirements:

• Be at least 25 years of age (30 years for exotic and high-performance vehicles)
• Possess a valid driver's license held for a minimum of 3 years
• Provide a valid government-issued photo ID
• Present a major credit card in your name
• Provide proof of insurance or purchase our comprehensive coverage
• Pass our driver verification and background check

We reserve the right to refuse service to any individual who does not meet these requirements or at our sole discretion.

Reservation and Payment

Reservations: All reservations are subject to vehicle availability. A reservation does not guarantee a specific vehicle but rather a vehicle category. We will make every effort to provide your requested vehicle.

Payment: Full payment or a security deposit is required at the time of booking. We accept major credit cards and bank transfers for confirmed reservations. All prices are in USD unless otherwise specified.

Security Deposit: A refundable security deposit ranging from $2,500 to $25,000 (depending on vehicle class) will be authorized on your credit card. This hold will be released within 7-14 business days after the vehicle is returned in acceptable condition.

Cancellation Policy:

• More than 7 days before rental: Full refund
• 3-7 days before rental: 50% refund
• Less than 3 days before rental: No refund
• No-shows: No refund and loss of security deposit

Vehicle Use and Restrictions

By renting a vehicle from VCARZ, you agree to the following conditions:

• Authorized Drivers: Only individuals listed on the rental agreement are permitted to drive the vehicle
• Geographic Restrictions: Vehicles may not be driven outside the continental United States without prior written approval
• Prohibited Uses: Racing, speed testing, driver training, towing, off-road driving, commercial use, or any illegal activities
• Smoking: All vehicles are strictly non-smoking. Violation will result in a $500 cleaning fee
• Pets: No pets allowed except certified service animals
• Mileage: Unlimited mileage within the approved geographic area for rentals over 3 days; daily rentals include 200 miles/day
• Fuel: Vehicle must be returned with the same fuel level as at pickup or a refueling fee will apply

Insurance and Liability

Insurance Coverage: You must maintain comprehensive and collision insurance with minimum limits of $1,000,000 per occurrence. If you cannot provide proof of adequate insurance, you must purchase our premium coverage.

Your Liability: You are responsible for all damage to or loss of the vehicle, including damage from weather, road conditions, theft (if keys are not secured), and vandalism. You are also liable for all traffic violations, parking tickets, toll charges, and impound fees incurred during the rental period.

Damage Assessment: VCARZ will assess any damage using authorized repair facilities. You agree to pay all repair costs, loss of use fees, and diminished value charges.

Vehicle Condition and Inspection

At the time of pickup, you will be provided with a detailed inspection report documenting the vehicle's condition. You are responsible for reviewing this report and noting any discrepancies before leaving the premises.

Upon return, the vehicle will be inspected for damage, cleanliness, and fuel level. Any new damage or excessive wear will be documented and charged to your account.

Professional detailing fees may apply if the vehicle is returned excessively dirty. Standard cleaning fee: $200-$500 depending on vehicle size and condition.

Extension and Early Return

Extensions: Rental extensions are subject to availability and must be requested at least 24 hours before the scheduled return time. Unauthorized extensions will result in additional charges of 1.5x the daily rate plus potential penalties.

Early Returns: Early returns do not qualify for refunds unless specifically stated in a promotional offer.

Late Returns: A grace period of 30 minutes is provided. Late fees of $100 per hour will apply thereafter, with a minimum charge of $500 for over 4 hours late.

Roadside Assistance and Breakdowns

VCARZ provides 24/7 roadside assistance for mechanical breakdowns, flat tires, and lockout services. Contact our emergency line immediately if you experience any issues.

You are responsible for damage resulting from:

• Continuing to drive after warning lights appear
• Improper use of vehicle controls or features
• Failure to maintain proper fluid levels
• Driving on inappropriate road surfaces

Unauthorized repairs without prior approval from VCARZ will not be reimbursed.

Accidents and Theft

In the event of an accident or theft, you must:

• Contact local law enforcement immediately and obtain a police report
• Notify VCARZ within 4 hours of the incident
• Complete our incident report form within 24 hours
• Cooperate fully with insurance investigators
• Not admit fault or liability at the scene

Failure to follow these procedures may result in denial of insurance coverage and full liability for all costs.

Limitation of Liability

VCARZ, its owners, employees, and affiliates are not liable for:

• Personal injury or property damage resulting from your use of the vehicle
• Loss, damage, or theft of personal belongings left in the vehicle
• Indirect, incidental, or consequential damages
• Any mechanical issues that arise during normal use, provided we offer reasonable assistance
• Delays in delivery or pickup due to circumstances beyond our control

Our total liability under this agreement shall not exceed the total rental fees paid for the reservation in question.

Indemnification

You agree to indemnify and hold harmless VCARZ, its owners, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use or misuse of the rental vehicle
• Violation of these Terms of Service
• Violation of any applicable laws or regulations
• Injury or damage to third parties

Privacy and Data

Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms of Service by reference. By using our services, you consent to our collection and use of your personal information as described in the Privacy Policy.

We may use GPS tracking and vehicle telematics for fleet management, theft recovery, and insurance purposes. This data may be shared with law enforcement if necessary.

Modifications to Terms

VCARZ reserves the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes are posted constitutes acceptance of the modified terms.

We will make reasonable efforts to notify you of material changes via email, but it is your responsibility to review these terms periodically.

Dispute Resolution and Governing Law

Governing Law: These Terms of Service are governed by and construed in accordance with the laws of the State of [State], without regard to conflict of law principles.

Arbitration: Any disputes arising from these terms or your use of our services shall be resolved through binding arbitration in accordance with the American Arbitration Association's Commercial Arbitration Rules. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Exceptions: Either party may seek injunctive relief in court for intellectual property violations or breach of confidentiality obligations.

Severability

If any provision of these Terms of Service is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining terms shall remain in full force and effect.

By making a reservation or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
